I bought some Dr Earths soil for maples and azaleas Thought it would help stop them from getting leaf scorch this summer. The rest are in this soil and dry out everyday so I am not worriedI agree, the first tree is likely dead. Honestly, the last few pictures don't show much to be optomistic about either. I don't see any buds at all and the bark seems to be turning that sallow brown grey color that means cambial death... time will tell, I guess. Fwiw, I don't like the looks of your soil... appears very organic heavy and way too wet.
